2. International Operations Disclosure

First Clipping Path is headquartered in Vilnius, Lithuania, operating under European Union jurisdiction. We serve clients across the European Union, the United Kingdom, and the United States of America.

United States:

First Clipping Path operates commercially in the US market. We do not currently maintain a registered US legal entity or a physical place of business in the United States. Contracts with US clients are governed by the laws of the Republic of Lithuania unless otherwise agreed in writing.

Production Operations — Bangladesh:

Image retouching and post-production services are carried out in part by our production team and contracted specialists based in Dhaka, Bangladesh. All production personnel operate under contractual agreements with First Clipping Path and are bound by our quality standards, confidentiality obligations, and data handling policies.

Transfers of client image data to our production facility in Bangladesh are conducted under appropriate contractual safeguards in accordance with Chapter V of the EU General Data Protection Regulation (GDPR), including Standard Contractual Clauses (SCCs) as approved by the European Commission. 3. Image Rights, Licensing & Liability Disclaimer

3.1 Client Responsibility for Image Rights

First Clipping Path provides post-production services exclusively on the basis that all image material submitted by the client has been lawfully produced and is free of third-party rights conflicts. By submitting files to First Clipping Path for processing, the client represents and warrants that:

• All photographic content has been produced with the appropriate model releases, property releases, and production licences in place;
• The client holds, or has obtained, all necessary intellectual property rights, usage rights, and clearances for the submitted imagery;
• No submitted image infringes the copyright, personality rights, or any other rights of third parties.

3.2 No Liability for Rights & Buyouts

First Clipping Path acts solely as a technical post-production service provider. We do not verify the licensing status, buyout agreements, talent fees, model release documentation, usage rights, or copyright clearances of any image material submitted to us for processing.

First Clipping Path explicitly assumes no liability — direct, indirect, or consequential — in connection with:

• Model or talent buyouts and related contractual obligations;
• Image licensing, syndication, or third-party distribution rights;
• Intellectual property disputes arising from the submitted content;
• Unauthorised use of images after delivery;
• Any claim brought by a third party in relation to the content of the submitted material.

The client remains solely and fully responsible for all rights-related matters. First Clipping Path's liability is strictly limited to the quality and technical execution of the post-production services agreed upon.

4. File Retention & Data Deletion Policy

4.1 Retention Period

First Clipping Path retains client image files — including source files, working files, and delivered outputs — for a maximum period of 30 (thirty) calendar days following the date of final delivery to the client.

4.2 Permanent Deletion

Upon expiry of the 30-day retention period, all copies of client files held by First Clipping Path and its production partners are permanently deleted from all active systems, storage environments, and backup locations. No archive copies are retained beyond this period.

4.3 Client Obligation

Clients are solely responsible for maintaining their own copies of delivered files. First Clipping Path accepts no liability for any loss of data or files following the expiry of the 30-day retention period. Clients requiring extended retention must request this in writing prior to delivery; extended retention may be subject to additional terms and fees.

4.4 Data Processing

The processing of personal data contained within submitted imagery (including images of identifiable individuals) is conducted in accordance with our Privacy Policy and applicable data protection law, including the GDPR. First Clipping Path acts as a data processor on behalf of the client (the data controller) for the purposes of GDPR Article 28.

5. EU AI Act Transparency Statement

5.1 Our Use of AI-Assisted Tools

First Clipping Path utilises Adobe Photoshop and associated Adobe Creative Cloud applications in our post-production workflow. Adobe Photoshop incorporates AI-powered features — including but not limited to Generative Fill, Remove Background, Neural Filters, and Object Selection — which are developed, trained, and provided by Adobe Inc. (San José, California, USA).

5.2 Role Classification under the EU AI Act

Under Regulation (EU) 2024/1689 (the EU AI Act), Adobe Inc. is the provider of the AI systems integrated into Photoshop. First Clipping Path operates as a deployer of those AI systems within the meaning of Article 3(4) of the EU AI Act. We do not develop, train, modify, or place AI systems on the market.

5.3 Risk Classification

The AI features we use within Adobe Photoshop are used for creative and technical image enhancement tasks including background removal, selection refinement, and visual correction. These applications do not fall within the high-risk AI system categories enumerated in Annex III of the EU AI Act. We do not use AI systems for biometric identification, employment decisions, creditworthiness assessment, or any other high-risk purpose.

5.4 Human Oversight

In accordance with our deployer obligations under Article 26 of the EU AI Act and our own quality standards, all AI-assisted outputs are reviewed, corrected where necessary, and approved by a qualified human retoucher before delivery to the client. AI tools accelerate certain technical tasks; they do not replace human judgement or final quality assessment.

5.5 No AI-Generated Imagery

First Clipping Path does not use generative AI to create, fabricate, or replace image content. We do not generate synthetic backgrounds, composite AI-created elements into client deliverables, or produce imagery that was not originally captured in a real photographic context — unless explicitly agreed in writing with the client and disclosed accordingly.

5.6 Limitation of Liability — AI Tool Performance

First Clipping Path assumes no liability for errors, inaccuracies, or unintended outputs produced by AI features within Adobe Photoshop or other third-party software tools. All AI-assisted results are subject to human review. As Adobe remains the provider and controller of those AI systems, any systemic issues with the underlying AI models are the responsibility of Adobe Inc. Clients wishing to opt out of any AI-assisted processing may request fully manual workflows; please notify us in writing before production begins.

6. Limitation of Liability — General

6.1 Content Liability

The contents of this website have been prepared with the greatest possible care. However, First Clipping Path cannot guarantee the accuracy, completeness, or timeliness of the content. As a service provider, we are responsible for our own content on this website in accordance with § 7 Abs. 1 TMG.

6.2 Link Liability

This website may contain links to external third-party websites over whose content First Clipping Path has no control. No liability is assumed for the content of linked external pages.
